I made a disability claim in November 2009, with a lawyer, I got approved last week. However, I got a letter saying that through they’re understanding I have been disabled since January 12th 2009 (which is true since I got fired for injury the day before) but they will only pay 5 months after January which is July 2009. So, they will pay me retroactive payments from July 2009 to today’s date. But they will also pay the lawyer from July 2009, when however I got a lawyer since November 2009. Should I speak about this problem, or is this how it is supposed to be?

I was at fault in a minor accident and got ticket for it. I know the other party who had claimed injury is claiming insurance with my insurance company. I would like to get information and documents related to the other party’s claim (e.g what injury) so as to help my case in court. Is my insurance company allowed to disclose the info to me? I am getting my own lawyer and has nothing to do with my insurance co. Thanks!

I was involved in a car accident and 3 of my passangers refuse medical treatment and stated they were fine. This was noted in the police report now they want to file a claim. Can they file a claim with the lawyer???

I was involved in a mortorbike accident where the other party was at fault and admitted to it. I racked up $13.5k in ER bills and since then have seens a sports medicine doctor for Type II shoulder seperation and rotator cuff injuries (about $2.5k), plus seeing a physical therapist (10 visits or so). I’m want to settle my case preferable without a lawyer with a fair settlement. I’ve read about the “multiply by 3 rule” and seems that it might not be valid. I’m wondering what a reasonable settlement should be for the pain & suffering/ special damages.
Could I get the services of a 3rd part adjuster to get a better idea?
This said accident happened in the bay area.

I slipped and fell on a lemon wedge on the floor of the lobby of a local casino. My knee twisted and mangled behind me and it hurt sooooo bad! I went to the ER and while there was nothing broken he suspects that I’ve torn my acl. I’m making an appt. with an ortho this week. The casino ENT filled out a lot of paperwork and took statements and said they had it all on camera…will a rep from the casino call me or should I call them after I see the ortho and have a diagnosis? I don’t want to sit around and wait, but I don’t want to look really anxious for a settlement either. Who usually makes the first move? I’d like to settle without a lawyer as I don’t want to drag it out for years.

I’m not satisfied at all with their customer/client service or lack thereof. The paralegals act is if they could care less about you or your case – not that I was looking for sympathy from them after my accident. I just expected them to be courteous and polite. Since my car accident on 10/5/07 I have spoken to my so called lawyer once. When I call to ask a question he doesn’t return my call. This is my first accident and I’ve never filed a personal injury claim with the aid of an attorney. I do not know what to expect as it pertains to the steps involved in moving forward towards settlement. When I’ve called to ask questions – my lawyers paralegal (who apparantly does all the work while the attorney does nothing but still gets paid) responded to me in a demeaning way, as if I was supposed to know this info. already. She always acts as if she doesn’t have time to speak to me. I can’t be the only one that’s having issues with this law firm. They seem to be everywhere (TV, radio etc.,

I was in a car accident two days before moving 400 miles away. The other driver’s insurance company is denying my claim because the driver is lying to save his job, and said I swerved into him. Even though the police report said he was at fault, they are unwilling to handle this properly.
Since I moved, do I use a lawyer where I now live, or do I need to go back to the county in which it happened?

USAA insurance company only wants to give me $1000.00 & my daughter $700.00 for our injuries due to their insureds boyfriend who did a burn out in a puddle of water and rear ended me. We hurt our backs and necks but they are somewhat better for the most part. At least a few days a week we still have to deal with some pain, or stiffness, soreness. The adjuster isnt even paying me for my time off from work. What should I do????I know we could get more but I dont want to hire a lawyer, plus I only have until this June 19, 2006 to do something. Help!!! I want to be able to write some sort of letter sounding like I know what I’m talking about.
